New York, 25 September 2026 – A delay linked to a large New Mexico data-centre campus is forcing lenders and investors to examine who bears the cost when artificial-intelligence infrastructure projects fall behind schedule. Oracle has issued a force-majeure notice in connection with the Jupiter campus being developed by a Blue Owl-backed business to support OpenAI. Blue Owl says the notice does not change the parties’ commitment to the project.
The reported trigger was a delay in securing power for the site. People familiar with the matter said the programme could be pushed back by about a year, though the precise contractual consequences have not been publicly established. Force majeure clauses may address events outside a party’s control, but they do not by themselves tell investors how delayed cash flows, construction costs or refinancing obligations will eventually be divided.
