Swift Haulage Subsidiary Wins Land Dispute in High Court; Defendant Lodges Appeal

KUALA LUMPUR, Sept 8, 2025 — Logistics player Swift Haulage Berhad has announced that its wholly owned subsidiary, Swift Logistics Yard Sdn Bhd, secured a favourable ruling in a contentious land possession case against North West Depoh Sdn Bhd at the Shah Alam High Court. The dispute centred on unpaid rentals and delayed land handover obligations tied to a tenancy arrangement.

High Court Ruling in Swift’s Favour

On 16 April 2025, the Shah Alam High Court ruled decisively in favour of Swift Logistics Yard, dismissing North West Depoh’s counterclaim and granting multiple awards and directives.

The court ordered North West Depoh to:

  • Deliver vacant possession of the disputed land to Swift Logistics Yard within 30 days of the judgment.
  • Pay RM338,216.26 in outstanding double rental for 12 acres covering April and May 2022.
  • Pay RM498,496.04 per month in rental for 27 acres of land from June 1, 2022, until vacant possession is delivered.
  • Pay an additional double rental of RM498,496.04 per month for the same period until the land is handed over.

The directives reflect the court’s recognition of Swift Logistics Yard’s rights under the tenancy agreement, as well as the financial liabilities accrued from North West Depoh’s alleged failure to vacate the land and settle overdue payments.

Appeal Filed by Defendant

Despite the ruling, the dispute is not fully settled. On 24 April 2025, North West Depoh filed a Notice of Appeal against the High Court’s decision, seeking to challenge the judgment. The appeal process means the matter could continue in the appellate courts, potentially delaying Swift’s ability to enforce the ruling and secure financial compensation.

For Swift Haulage, one of Malaysia’s leading integrated logistics providers, the case underscores both the opportunities and risks inherent in managing industrial land assets.
