Penang, 27 February 2026 — The Penang state government has affirmed that Executive Councillor (EXCO) Fahmi Zainol remains “innocent until proven guilty” and will continue carrying out his official duties as normal, despite ongoing legal proceedings involving charges under the Penang Hills Corporation Act 2022.
Penang Chief Minister Chow Kon Yeow said Fahmi, who faces 10 charges related to alleged malpractice in connection with a land transaction involving the Penang Hills Corporation, has not been convicted by a court. He emphasised that, in line with Malaysia’s legal principles, Fahmi continues to be presumed innocent while the matter is sub judice.
“We respect the rule of law and the right to a fair trial,” Chow said in a statement on Friday. “As far as the Penang state administration is concerned, YB Fahmi will remain as an EXCO member and continue to fulfil his responsibilities unless a court rules otherwise.”
Chow also pointed out that the charges against Fahmi do not automatically disqualify him from holding public office, as long as no conviction has been entered. The Chief Minister underscored that the state government will support full due process while ensuring continuity in governance and public service delivery.
Fahmi was charged in the Sessions Court in George Town in late January with allegedly causing the Penang Hills Corporation to make decisions that resulted in losses to the public body. He has pleaded not guilty and is expected to return to court as proceedings continue.
The case has attracted significant local media coverage and public interest, given Fahmi’s prominent role in the Penang state leadership and the broader context of governance integrity and accountability in Malaysian politics.
