Luxembourg, 3 November 2026 – An adviser to the Court of Justice of the European Union said AI chatbot answers may infringe press publishers’ rights in certain circumstances when they retrieve and reuse online publications. Advocate General Maciej Szpunar delivered the non-binding opinion in case C-250/25, involving Google Ireland Ltd.’s Gemini service and a Hungarian website operator.

For Asian technology businesses and investors, the opinion puts product design, access controls and content licensing within the commercial assessment of AI services. It is not a judgment against Google or a general prohibition on reporting news facts. The court’s judges will deliberate before issuing their decision, and no damages award or licensing fee was announced.
