Texas Sues Meta and WhatsApp Over Encryption and Privacy Claims

Austin, 22 May 2026 – Texas has filed a lawsuit against Meta Platforms Inc. and WhatsApp, alleging that the companies misled users over privacy and encryption claims tied to the messaging platform.

The lawsuit, filed by the Texas Attorney General’s Office, accuses WhatsApp and its parent company of deceptive practices under the Texas Deceptive Trade Practices Act. The state alleges that WhatsApp promoted its service as protected by end-to-end encryption while retaining access to nearly all private messages on the platform. Meta has denied the allegations, stating that WhatsApp cannot access encrypted user communications.
