Manhattan, 18 September 2026 – Newly public court filings have intensified the dispute over whether OpenAI and Microsoft’s use of copyrighted material to train AI systems qualifies as fair use, as claimants argue that executives’ internal statements undermine the companies’ position on product substitution.

The filings disclosed previously redacted statements attributed to executives including OpenAI president Greg Brockman and Microsoft chief executive Satya Nadella. The claimants say the statements support their argument that AI products can replace the material used in training.
