Washington, 30 September 2026 – The US Supreme Court has temporarily cleared the administration to continue rapid deportations to countries other than migrants’ homelands while it reviews the legality of the policy. An order dated 29 September stayed a lower court judgment that required greater notice and an opportunity to raise objections before removal. The justices also agreed to hear the case in their December 2026 argument session. The stay is an interim procedural ruling, not a final decision that the policy is lawful.
The dispute concerns what safeguards apply when a person is sent to a country with which they have no prior connection. The lower court had required meaningful notice of the destination and a chance to present fear of persecution or torture. The administration argued those requirements obstruct removals. Lawyers for migrants argued that accelerated transfers can expose people to serious harm before their concerns are assessed.
